Basis obligations

Basic definitions 

 

Electrical and electronic equipment means devices which need an electrical current or an electromagnetic field for their operation, and devices for production, transfer and measurement of such current and field, designed for application under a voltage value of up to 1 000 V for alternating current and up to 1 500 V for direct current.

A device is considered electrical and electronic equipment if it meets the stated conditions and at the same time the exceptions below does not apply to it.

Waste from electrical and electronic equipment means electrical and electronic equipment being waste, including all components, construction elements and consumable materials which are part of electrical and electronic equipment at the time the holder disposes of it.

Waste from household electrical and electronic equipment means waste from electrical and electronic equipment, which comes from households and from commercial, industrial, institutional and other sources, being by its character and amount similar to the waste which originates from households; waste from electrical and electronic equipment likely to be used by households and non-household users is always considered household electrical waste.

Waste from electrical and electronic equipment other than from household means every electrical and electronic waste not listed in the previous paragraph.

Placing of electrical and electronic equipment on the market means the first availability of electrical and electronic equipment on the market of the Slovak Republic in the framework of a business activity.

Availability of electrical and electronic equipment on the market means supply of electrical and electronic equipment for distribution, consumption or use on the market of the Slovak Republic in the framework of business activity, whether for a fee or free of charge.

Producer of electrical and electronic equipment means every natural person – entrepreneur or legal entity who, regardless of the sales techniques used, including mail order and internet sales

a) has its registered office or place of business in the territory of the Slovak Republic and produces electrical and electronic equipment under its own name or trademark, or orders the design or production of electrical and electronic equipment and placed them on the market under its own name or trademark,

b) has its registered office or place of business in the territory of the Slovak Republic and repeatedly sales under its own name or trademark in the territory of the Slovak Republic electrical and electronic equipment produced by different suppliers; a seller who resells is not considered a producer if the producer's mark according to letter a) is found on the electrical and electronic equipment,

c) has its registered office or place of business in the territory of the Slovak Republic and places on the market of the Slovak Republic in the framework of business activities electrical and electronic equipment from another member State or non-member state,

d) sells electrical and electronic equipment in the territory of the Slovak Republic by means of remote communication directly to the households or other users and has its registered office or place of business in another member state or non-member state (hereinafter referred to as „foreign producer of electrical and electronic equipment“ ),

f) has its registered office or place of business in the territory of the Slovak Republic and in the framework of its business activities on the basis of a contract concluded at a distance sells electrical and electronic equipment directly to the user in another EU member state,

Distributor of electrical and electronic equipment means every natural person – entrepreneur or legal entity in the supply chain that makes available electrical and electronic equipment on the market in the framework of its business activities; distributor can be a producer of electrical and electronic equipment at the same time.

 

Basic obligations related to electrical and electronic equipment

A company that is considered a producer of electrical and electronic equipment has the following selected obligations:

  • To be registered in the Register of electrical and electronic equipment producers and to notify the modifications of the registered data,
  • To fulfill the information obligation toward the end-users of electrical and electronic equipment, toward public and processing facility,
  • To record and retain evidence and to notify the Ministry the data contained therein and to retain the notified data,
  • To bear all financial expenses related to the collection, transport, preparation for reuse, recovery, recycling, processing or disposal of separately collected waste belonging to the reserved waste stream
