The Act applies in the same extent to both, Slovak and foreign companies. The institute of so-called authorized representative is relevant of the foreign companies. If a producer does not have a seat or place of business in the SR territory he will appoint an authorized representative for fulfillment of his obligations, which can be a legal or natural person – entrepreneur with a seat or place of business in the SR territory, and the obligations of a producer will be performed by this authorized representative. Organizational component or operation unit of this person, which does not have legal personality, can not act as an authorized representative of a foreign company without seat or place of business in the SR territory.
An authorized representative is responsible for performance of all obligations of a producer and he acts under his own name. The authorization is granted for at least one year. An authorized representative must be listed in the application for registration in the Register of producers.
